By accessing or using the Budy POS application, Budy Admin dashboard, or Budy web shop (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.
These Terms apply to all users, including business operators, employees, and customers accessing the web shop.

We reserve the right to suspend or terminate accounts that violate these Terms.
You agree to use our Services only for lawful purposes and in accordance with all applicable local, national, and international laws and regulations, including those related to cannabis commerce in your jurisdiction.

You retain ownership of all business data you enter into our Services, including products, orders, customer information, and financial records. We do not claim ownership of your content.
You grant us a limited license to store, process, and transmit your data solely for the purpose of providing and improving our Services.
Each business operates within its own isolated tenant environment. Your data is kept strictly separate from other businesses using the platform. We maintain technical and organizational measures to ensure this separation.
Budy POS operates with an offline-first architecture. While we strive to maintain reliable synchronization, we are not responsible for data inconsistencies that may arise from extended offline periods or synchronization conflicts. You are responsible for verifying data accuracy.
We strive to maintain high availability of our Services but do not guarantee uninterrupted access. We may temporarily suspend access for maintenance, updates, or unforeseen circumstances. We will provide advance notice of planned downtime when possible.
Pricing for our Services is as communicated during sign-up or through our sales channels. We reserve the right to change pricing with 30 days' advance notice. Free trial periods, if offered, are subject to the terms communicated at the time of the offer.
The Budy platform, including its software, design, branding, and documentation, is owned by Budy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Services without written permission.
Our Services integrate with third-party hardware and software (Bluetooth scales, printers, scanners, Google services, etc.). We are not responsible for the functionality, availability, or terms of third-party products and services.
To the maximum extent permitted by law, Budy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Services in the twelve months preceding the claim.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
You are solely responsible for ensuring your use of Budy complies with all applicable laws and regulations in your jurisdiction, including cannabis licensing, reporting requirements, and tax obligations. Budy is a technology provider and does not provide legal or compliance advice.
Either party may terminate these Terms at any time. Upon termination:
We may modify these Terms at any time. We will notify you of material changes through the Services or via email. Continued use after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms shall be resolved in the courts of Amsterdam, the Netherlands.
If you downloaded the Budy POS application from the Apple App Store, the following additional terms apply and supplement the terms above. In the event of any conflict between these terms and the terms below, the terms below control with respect to your use on Apple devices.
You acknowledge that these Terms are entered into between you and Budy only, and not with Apple, Inc. ("Apple"). Apple is not responsible for the Budy POS application or its content. To the extent these Terms provide any usage rules or restrictions that conflict with Apple's Licensed Application End User License Agreement, the more restrictive terms shall apply.
The license granted to you for Budy POS is a limited, non-transferable license to use the app on any Apple-branded products that you own or control, subject to the Apple Media Services Terms and Conditions.
Budy is solely responsible for providing any maintenance and support services for the Budy POS application, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the application.
Budy is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Budy POS to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the application.
Budy, not Apple, is responsible for addressing any claims by you or any third party relating to Budy POS or your possession and/or use of the application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that Budy POS or your possession and use of the application infringes that third party's intellectual property rights, Budy, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
